Please read this before you use the app. It includes a release of liability and a limitation on what you can recover from us. If you don’t agree, don’t use Wild Ones Enduro.
These terms are an agreement between you and Wild Ones Enduro LLC, an Idaho limited liability company doing business as Wild Ones Enduro (“Wild Ones Enduro,” “we,” “us,” “our”). They cover the Wild Ones Enduro mobile app, the website at wildonesenduro.com, and everything you do through them (the “Service”).

You must be 18 or older to use Wild Ones Enduro. By creating an account you confirm that you are 18 or older and legally able to enter this agreement. We close accounts that don’t meet this requirement.
Wild Ones Enduro is a coordination tool. Riders use it to form crews, post rides, RSVP, and talk to each other.
We do not organize, lead, supervise, inspect, permit, or insure any ride. We do not verify anyone’s skill, equipment, license, registration, or fitness to ride. We do not check trail conditions or land status.
Crew admins, ride leaders, and organizers are riders using the app. They are not our employees, agents, contractors, or representatives, and they have no authority to act for us or bind us. Nothing in these terms creates a partnership, joint venture, agency, or employment relationship between us and any rider.
Riding off-road motorcycles is inherently dangerous and can result in serious injury, permanent disability, or death.
The risks include, and are not limited to: crashes, collisions with other riders or vehicles, rocks, ruts, jumps, drops, trees, wildlife, water crossings, mechanical failure, fire, weather, heat, cold, altitude, remote terrain, delayed emergency response, and the acts or omissions of other riders, ride leaders, landowners, and third parties. Some risks are not obvious and not foreseeable.
You knowingly and voluntarily assume all of these risks, whether known or unknown, and whether caused by the negligence of any party or by any other cause.
You are solely responsible for your own safety, your equipment and its condition, your fitness to ride, your training, your protective gear, your fuel and water and navigation, and for riding within your ability and within the law. You agree to wear appropriate protective gear. You agree to carry your own health insurance and to be responsible for your own medical costs.
We have no duty to monitor any ride, to respond to any emergency, or to coordinate rescue or medical care.
To the fullest extent permitted by law, you release, waive, and discharge Wild Ones Enduro LLC and its members, managers, officers, employees, contractors, and agents (together, the “Company”), and separately release crew admins, ride leaders, and other riders, from any and all claims, demands, damages, losses, costs, and causes of action of every kind, whether known or unknown, for personal injury, illness, death, or property damage arising out of or related to any ride you post, join, attend, or learn about through the Service, or to the conduct of any other rider.
This release covers claims based on ordinary negligence. It does not cover conduct that cannot be released under applicable law.
You agree not to bring any such claim, and you agree that this release binds your heirs, executors, administrators, and anyone claiming through you.
Meet-up spots, ride details, and any trail information in the app are typed in by riders as free text. We do not verify any of it. The app does not provide maps, routes, navigation, or location services.
Trails close. Conditions change. What one rider posts about a trail may be wrong, out of date, or based on a ride from years ago.
You are responsible for confirming that any trail you ride is open, legal, and on land you are permitted to use, and for holding current OHV registration and any permits, stickers, or passes your state or the managing agency requires. Riding on closed trails or on private property without permission is your responsibility alone.
Wild Ones Enduro has zero tolerance for objectionable content and for abusive riders. There are no exceptions.
You agree not to post, send, or share content that is harassing, threatening, hateful, discriminatory, violent, sexually explicit, obscene, illegal, or otherwise objectionable in our sole judgment. You agree not to harass, bully, impersonate, stalk, or otherwise abuse another rider.
We may remove any content and terminate any account at our sole discretion. We are not obligated to monitor content before it is posted, and reviewing a report does not make us responsible for what riders post.
You keep ownership of what you post. You give us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, copy, display, and distribute your content for the purpose of operating, improving, and promoting the Service. This license ends when you delete the content, except for copies in backups and content other riders already received.
You confirm that you have the rights to everything you post, and that posting it doesn’t infringe anyone else’s rights.
You are responsible for all activity on your account and for everything posted from it. Keep your email secure. Tell us right away if you think someone else has access.
You may delete your account at any time from Profile → Delete account, or by emailing support@wildonesenduro.com. Deletion removes your profile and your content from the app. Copies may remain in backups for a limited period, and we may retain records we are required to keep by law, need to resolve a dispute, or need to enforce these terms. Content you sent into a crew chat may remain visible to that crew. Reports you filed are deleted with your account. Reports other riders filed about you are kept.
Our Privacy Policy explains what we collect and how we use it. The app does not access your device location. Any place you see in the app, such as a city or a meet-up spot, was typed in by a rider.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT MESSAGES WILL BE DELIVERED, OR THAT RIDE OR TRAIL INFORMATION POSTED BY RIDERS IS ACCURATE, CURRENT, COMPLETE, LEGAL, OR SAFE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
THE COMPANY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF USE, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.
Some states don’t allow certain limitations, so parts of this section may not apply to you.
You will indemnify, defend, and hold the Company harmless from any claim, demand, loss, damage, cost, or expense, including reasonable attorneys’ fees, brought by a third party and arising out of your content, your conduct, your riding, your use of the Service, or your breach of these terms.
You may stop using the Service at any time. We may suspend or terminate your account at any time, with or without notice, for any reason, including a violation of these terms or conduct we judge harmful to other riders.
If you downloaded the app from the Apple App Store or Google Play:
If you believe content on the Service infringes your copyright, send a notice to support@wildonesenduro.com with enough detail to identify the work and the content, your contact information, and a statement made under penalty of perjury that you are authorized to act. We remove infringing content and terminate repeat infringers.

We may update these terms. We will post the updated version in the app and on the website with a new effective date, and we will notify you in the app before material changes take effect. Continuing to use the Service after an update means you accept the revised terms.
These terms and any dispute arising from them are governed by the laws of the State of Idaho, without regard to conflict-of-laws rules. Any lawsuit must be brought in the state or federal courts located in Ada County, Idaho, and you consent to their jurisdiction.
